General Terms and Conditions (GTC)

. Scope

These terms and conditions apply to contracts for the rental of hotel rooms for accommodation, as well as all other services and deliveries provided by Schwollbachhof to the customer in this context (“Hotel Accommodation Contract”). The term “Hotel Accommodation Contract” includes and replaces the following terms: accommodation, guest accommodation, hotel, and hotel room contract.

2. Conclusion of contract, contract partners, limitation period

The contractual partners are Manz GmbH & Co. KG (owner of the Schwollbachhof, hereinafter referred to as the “Hotel”) and the customer. The contract is concluded upon the hotel’s acceptance of the customer’s request. The hotel reserves the right to confirm the room booking in text form. The contract is concluded as soon as the room has been ordered and confirmed online, by telephone, or in writing, or, if a written confirmation was not possible due to time constraints, has been made available.

3. Services, prices, payment, offsetting

The hotel is obligated to provide the services ordered by the customer and confirmed by the hotel. The customer is obligated to pay the hotel’s agreed prices for these services. The agreed prices include the applicable statutory value-added tax. Hotel invoices are payable immediately upon receipt without deduction, unless otherwise agreed. The hotel is entitled to request an appropriate advance payment at any time.

4. Customer withdrawal (cancellation, non-use of services)

Any withdrawal by the customer from the contract concluded with the hotel requires the hotel’s written consent. If this consent is not obtained, the agreed price under the contract must be paid even if the customer does not use the contractual services. The hotel is obliged to reassign unused rooms to other parties if possible. The customer reserves the right to prove that the damage was lower, and the hotel reserves the right to prove that the damage was higher.

” Flex Rate “: Free cancellation up to 7 days prior to arrival. Cancellations made between 7 and 1 day prior to arrival will incur a 60% cancellation fee. Cancellations on the day of arrival or in the event of a no-show will incur a 100% charge. One rebooking is possible free of charge up to 3 days prior to arrival, to an alternative date within 12 months, subject to availability and any applicable price differences. Cancellation fees apply for shorter-term rebookings or cancellations. A valid credit card is required to guarantee the booking. Payment is made on-site at check-out, either in cash, by debit card, or by credit card.

” Best Price “: This rate is a special rate with special conditions: Free cancellation or rebooking is not possible. Upon booking, the entire price of the stay is due immediately and will be charged to the specified payment method. No refunds are available for cancellations or no-shows. Rebookings are not possible, even for other dates or persons. We recommend purchasing travel cancellation insurance to protect yourself against unforeseen events.

” Long-term advantage “: 10% discount for stays of 7 nights or more. Free cancellation up to 7 days before arrival. 5. Cancellation by the hotel

The hotel is entitled to withdraw from the contract for objectively justified reasons, in particular if force majeure or other circumstances beyond the hotel’s control make the fulfillment of the contract impossible or if rooms are booked under misleading or false information regarding essential facts.

6. Room availability, handover and return

Reserved rooms are available to the customer from 3:00 PM. On the day of departure, rooms must be vacated and made available to the hotel by 11:00 AM at the latest, unless a later departure time has been expressly agreed upon.

7. Hotel liability

The hotel is liable for its contractual obligations. This liability is limited to deficiencies in performance resulting from the hotel’s intent or gross negligence. Furthermore, the customer is obligated to notify the hotel in a timely manner of the possibility of exceptionally high damages.

8. Customer’s liability for damages

The customer is liable for all damage to the building or inventory caused by themselves, their guests, or other third parties within their area. The hotel may request appropriate security (e.g., a deposit).

9. Loss or damage to items brought along

Personal belongings are kept at the hotel at the customer’s own risk. The hotel assumes no liability for loss, destruction, or damage, except in cases of gross negligence or willful misconduct on the part of the hotel.

10. Final provisions

Changes and additions to the contract, the acceptance of the application, or these Terms and Conditions must be made in writing. Unilateral changes or additions by the customer are invalid. Should individual provisions of these Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions.
